By accessing or using kontakai.com, our chat widget, voice AI agent, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services.
KontakAI LLC provides AI-powered voice and chat automation tools, including AI voice agents, AI chat widgets, automated lead follow-up (SMS, email, and call), and automated review request messaging, designed to help businesses capture leads, answer customer inquiries, and automate follow-up communications.
You must be at least 18 years old and have the authority to enter into these Terms on behalf of yourself or the business you represent to use the Services.
Current pricing plans are listed at kontakai.com/#pricing and include a Starter plan and a Pro plan, each billed monthly, plus a one-time setup fee on initial signup (no setup fee applies to plan upgrades). Services are billed month-to-month and may be canceled at any time with 30 days' written notice to mike@kontakai.com. Fees are non-refundable except as required by law or as otherwise agreed in writing.
By providing your phone number through our chat widget, website forms, or during a service inquiry, you consent to receive informational and transactional calls and text messages from KontakAI LLC related to your inquiry or service, including via automated means. Message and data rates may apply. Message frequency varies. Consent to receive messages is not a condition of purchase. Reply STOP to any message to opt out, or HELP for assistance. See our Privacy Policy for more on how we handle your data.
You agree not to use the Services to: transmit unlawful, harassing, or fraudulent content; violate any applicable telecommunications or anti-spam law (including the TCPA and CAN-SPAM Act); or interfere with or disrupt the integrity of the Services.
All content, software, and technology underlying the Services are owned by KontakAI LLC or its licensors. These Terms do not grant you any right to use KontakAI LLC's trademarks, logos, or branding without prior written permission.
The Services rely on third-party platforms (including GoHighLevel and telephony/SMS carriers) to deliver messaging, voice, and automation functionality. KontakAI LLC is not responsible for outages or failures caused by these third-party providers.
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. KontakAI LLC does not guarantee that the Services will be uninterrupted, error-free, or that AI-generated responses will always be accurate.
To the maximum extent permitted by law, KontakAI LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Services.
KontakAI LLC may suspend or terminate access to the Services for any customer who violates these Terms. You may cancel your Services at any time per the terms in Section 4.
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law principles.
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
